SUMMARY: This notice announces the availability of EPA's Final WorkPlans and Proposed Registration Review Decisions for the pesticidescases Capric (Decanoic) Acid and Sodium Hydroxide (Mineral Bases,Strong), and opens a public comment period on the proposedregistration review decisions. Registration review is EPA'speriodic review of pesticide registrations to ensure that eachpesticide continues to satisfy the statutory standard forregistration, that is, that the pesticide can perform its intendedfunction without unreasonable adverse effects on human health orthe environment. Through this program, EPA is ensuring that eachpesticide's registration is based on current scientific and otherknowledge, including its effects on human health and theenvironment.

SUPPLEMENTARY INFORMATION:
I. General Information
A. Does this Action Apply to Me?
This action is directed to the public in general, and may be ofinterest to a wide range of stakeholders including environmental,human health, farm worker, and agricultural advocates; the chemicalindustry; pesticide users; and members of the public interested inthe sale, distribution, or use of pesticides. Since others also maybe interested, the Agency has not attempted to describe all thespecific entities that may be affected by this action. If you haveany questions regarding the applicability of this action to aparticular entity, consult the person listed under FOR FURTHERINFORMATION CONTACT.
B. What Should I Consider as I Prepare My Comments for EPA?
1. Submitting CBI. Do not submit this information to EPA throughregulations.gov or e-mail. Clearly mark the part or all of theinformation that you claim to be CBI. For CBI information in a diskor CD-ROM that you mail to EPA, mark the outside of the disk orCD-ROM as CBI and then identify electronically within the disk orCD-ROM the specific information that is claimed as CBI. In additionto one complete version of the comment that includes informationclaimed as CBI, a copy of the comment that does not contain theinformation claimed as CBI must be submitted for inclusion in thepublic docket. Information so marked will not be disclosed exceptin accordance with procedures set forth in 40 CFR part 2.
2. Tips for preparing your comments. When submitting comments,remember to:
i. Identify the document by docket ID number and otheridentifying information (subject heading, Federal Register date andpage number).
ii. Follow directions. The Agency may ask you to respond tospecific questions or organize comments by referencing a Code ofFederal Regulations (CFR) part or section number.
iii. Explain why you agree or disagree; suggest alternatives andsubstitute language for your requested changes.
iv. Describe any assumptions and provide any technicalinformation and/or data that you used.

II. Background
A. What Action is the Agency Taking?
This notice opens a 60-day public comment period on the subjectproposed registration review decisions. The Agency is proposingregistration review decisions for the pesticide cases shown in thefollowing Table.






The dockets for registration review of these pesticide casesinclude earlier documents related to the registration review of thesubject cases. For example, the review opened with the posting of aSummary Document, containing a Preliminary Work Plan (PWP), forpublic comment. Because no comments were received, and because theAgency required no further risk assessments to completeregistration review of these cases, the Final Work Plan andProposed Decision were combined into a single document. Thedocuments in the initial docket described the Agency's rationalefor not conducting new risk assessments for the registration reviewof Sodium Hydroxide (Mineral Bases, Strong) and Capric (Decanoic)Acid. These proposed registration review decisions now included inthe dockets continue to be supported by those rationales includedin documents in the initial dockets. Following public comment, theAgency will issue a final registration review decision for eachcase.
The registration review program is being conducted undercongressionally mandated time frames, and EPA recognizes the needboth to make timely decisions and to involve the public. Section3(g) of the Federal Insecticide, Fungicide, and Rodenticide Act(FIFRA) as amended in 1996 required EPA to establish by regulationprocedures for reviewing pesticide registrations, originally with agoal of reviewing each pesticide's registration every 15 years toensure that a pesticide continues to meet the FIFRA standard forregistration. The Agency's final rule to implement this program wasissued in August 2006 and became effective in October 2006 andappears at 40 CFR part 155.40 et seq. The Pesticide RegistrationImprovement Act of 2003 ("PRIA") was amended and extended inSeptember 2007. FIFRA as amended by PRIA in 2007 requires EPA tocomplete registration review decisions by October 1, 2022 for allpesticides registered as of October 1, 2007. The registrationreview final rule provides for a minimum 60-day public commentperiod for all proposed registration review decisions. This commentperiod is intended to provide an opportunity for public input and amechanism for initiating any necessary amendments to the proposeddecision(s). All comments should be submitted using the methods inADDRESSES, and must be received by EPA on or before the closingdate. These comments will become part of the Agency Dockets forSodium Hydroxide (Mineral Bases, Strong) and Capric (Decanoic)Acid. Comments received after the close of the comment period willbe marked "late." EPA is not required to consider these latecomments. The Agency will carefully consider all comments receivedby the closing date and will provide a Response to CommentsMemorandum in the Dockets and www.regulations.gov. The finalregistration review decisions will explain the effect that anycomments have had on the decisions.
