Mayor arrives for text message hearing in court

"You are a licensed attorney, you are a public official," the judgetold Kilpatrick after hearing evidence of an alleged assaultThursday by Kilpatrick on a Wayne County detective who wasattempting to serve a summons on Bobby Ferguson, a city contractorand close friend of the mayor. "Everything you do and everythingyou say is in some way recorded and obviously it's something youhave to think about."
Kilpatrick paid the bond when he left court Friday afternoon andvolunteered to take an immediate drug test.
Assistant Wayne County Prosecutors Robert Moran had asked thatKilpatrick's personal bond be revoked and he have to "put moneyup."
Wayne County Prosecutor Kym Worthy charged Kilpatrick in March withperjury and other felonies in connection with his testimony at apolice whistle-blower trial in 2007. Also charged was ChristineBeatty, Kilpatrick's former chief of staff.
Prosecutors argued Kilpatrick violated his bond in that case whenhe got into a scuffle with a representative of the prosecutor'soffice Thursday afternoon. Moran said the mayor exhibited"assaultive conduct."
Detective Brian White, a sheriff's officer assigned to the WayneCounty Prosecutor's Office, said Kilpatrick threw him off the porchof a home owned by Kilpatrick's sister Ayanna. The mayor shoutedobscenities and racial remarks, White told the court.
White went to the front door of Ayanna Kilpatrick's home with hispartner, Joanne Kinney, looking for Bobby Ferguson. AyannaKilpatrick is married to Daniel Ferguson, Bobby Ferguson's cousin.
"He grabbed me and threw me," White testified, adding thatKilpatrick was irate . Under cross-examination he said he was thrown into a collisionwith Kinney.
White also testified the mayor shouted at Kinney: "How can a blackwoman be riding in a car with a man named White?"
The mayor also said, according to White: "Leave my (expletive)family alone" and "get the (expletive) out of here" and instructedother people at the home "Don't tell those (expletive) anything."
After the hearing, the mayor's attorney, James C. Thomas saidKilpatrick did not use that language.
White and his partner were going to serve another summons in theneighborhood when they noticed a Ferguson contracting truck infront of the home, along with the mayor's black Escalade. DanielFerguson works for a Ferguson company.
White said he did not have a chance to leave before the mayorplaced two hands on him and tossed him off the porch.
The mayor, who said "I'm fine," as he left the courtroom headed forthe probation office, stared at White as he testified Friday.
Kinney also took the stand. She had been a former Detroit homicidecop. She confirmed White's story that the mayor pushed White andlaunched into a tirade.
"He was irate," she said. She also recalled how Kilpatrick, whomshe had never met before, told her: "You are a black woman with aman with the last name White ... You should be ashamed foryourself."
The whole incident was a blur, Kinney recalled. "It happened sofast. We were just looking for Bobby Ferguson ... I couldn'tbelieve this was happening. "
White said he later went for a medical exam at Henry Ford anddoctors indicated he may have a fractured hip. The incidenthappened in the afternoon. He went to the hospital around 10 p.m.
After White said he was "tossed" he left the property. "I was toldto get the (expletive) here," he said.
"I was not mad at the mayor," White said.
White added there were two Kilpatrick bodyguards at the scene, onein the Escalade and one outside the vehicle.
Giles then asked the one bodyguard who was present during theincident and who had accompanied the mayor to court to leave thecourtroom.
White said after leaving they saw a pickup truck with signageindicating Ferguson Enterprises parked outside Ayanna Kilpatrick'shome.
White is the officer in charge of the mayor's case. He said he wasalso looking to serve a subpoena to Kandia Milton, the mayor'schief of staff.
The mayor has been free on his own recognizance and has not put upany money.
Before the testimony begun, Giles, said, "The issue is not if therewas an assault ... the issue in the court's eyes ... is obstructionof justice, not a misdemeanor."
Worthy's investigation began after pager text messages published inJanuary pointed to a sexual relationship between Kilpatrick andBeatty and possible perjury about the nature of their relationshipand circumstances surrounding the removal of Deputy Police ChiefGary Brown when they both testified in that civil case last year.
